Understanding the Options

Marriage Green Card

  • Who it’s for: Couples already married.

  • Process: The U.S. citizen files Form I-130, Petition for Alien Relative. Once approved, the foreign spouse proceeds with either consular processing or adjustment of status.

  • Timeline: Generally 10 to 14 months, but can vary based on several factors.

  • Pros: Grants permanent residency upon approval, allowing the spouse to work and travel freely.

  • Cons: The process can be lengthy and costly, with potential delays due to additional documentation requests.

Fiance Visa (K-1 Visa)

  • Who it’s for: Engaged couples planning to marry within 90 days of the foreign fiancé(e)'s arrival in the U.S.

  • Process: Only U.S. citizens can sponsor. The U.S. citizen files Form I-129F, Petition for Alien Fiance. After approval, the foreign fiancé(e) completes the DS-160 and attends a consular interview. They must marry within 90 days of entry and then apply for adjustment of status.

  • Timeline: 6 to 9 months for the visa process, plus an additional 10 to 14 months for the green card after marriage.

  • Pros: Allows quicker initial entry into the U.S.

  • Cons: No immediate work authorization, longer total time to permanent residency, additional steps and fees, and the requirement to marry within 90 days.


Making the Decision

Choosing between a Marriage Green Card and a Fiance Visa depends on your specific circumstances and priorities. If you’re already married and can handle a potentially longer process, the Marriage Green Card might be the better option. If you’re engaged and eager for a quicker entry into the U.S., the Fiance Visa could be more suitable.
